TERMS AND CONDITIONS

1. Reservations, Payment and Terms 

1.1. The Guesthouse, Coach House, and Manor House operate on a Bed & Breakfast basis but can arrange other services such as dinner, transport, functions, events or conferences at the guests own cost. Reception can also provide details of suppliers that can provide these services directly to the guest.

1.2. Reservations are accepted on a ‘per person’ basis in the Guesthouse. Rates are therefore subject to the number of people that occupy a room. The names and relationship to the guest of the additional persons sharing the room must be provided when the reservation is made. Children from the ages of 0-7 stay free of charge, 7-12 pay half the adult price and thereafter full adult rates will apply.

1.3. The Coach House operates on a room basis. We regret no children due to open pools.

1.4. Bookings can only be confirmed once a 50% deposit on accommodation, or valid credit card details with authorisation to debit, along with the guest name, surname, number of persons sharing each room, cell phone number of the guest, confirmed payment method and expected time of arrival of each guest is received. Should the booking be made by a Travel Agent or Tour operator, the booking will be deemed to have been confirmed on receipt of their written confirmation and/or receipt of voucher.

1.5. If you want to change a booking you will be liable to pay for the difference in rates applicable to your new stay dates.

 

2. Cancellation policy: 

2.1. 50% deposit is required within 48hr to secure the booking when made. This excludes bookings made by contracted tour operators and agents where the booking will be secured subject to their written confirmation.

2.2. 25% charged of total booking amount if cancelled 30+ days before arrival. This excludes bookings made by contracted tour operators and agents where the booking will be secured subject to their written confirmation.

2.3. 50% charged of total booking amount if cancelled between 15 – 29 days before arrival.

2.4. 100% charged of total booking amount if cancelled 14 days or less of arrival and in case of a no show.

2.5. The guest retains personal liability for the bill until the employer, agent or person that made the reservation on his or her behalf has settled the account.

2.6. Cash, internet transfers and all major credit cards are valid payment methods. Cheques are not accepted.

2.7. Rates are subject to change without prior notice. Quotations are valid for 48hrs unless otherwise specified.

2.8. Refunds will only be made after payment has been finally cleared by the bank or Credit Card Company. This process can take in excess of 30 days.

2.9. A minimum administration fee of 10% will be added to any service the guest house pays for on behalf of the guest.

 

3. Arrival and Departure 

3.1. Check in time is between 14:00 and 17:00 unless prior arrangements have been made. No check-in will be made after 20:00. This is necessary to ensure the security, comfort and well-being of other guests.

3.2. Check out time is between 08:30 and 11:00 unless prior arrangements have been made. No check-out after 13:00. This is to enable the room to be prepared in time for new arrivals. Guests that check out after 13:00 without prior arrangement will be liable for an extra night’s accommodation, as we will not be able to service the room in time for new arrivals.

 

4. Parking and Access 

4.1. Visitors and guests may only park on the designated parking area. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd accepts no responsibility for any loss or damage that may occur to vehicles or property or death or injury to guests or visitors that may result should this not be adhered to. Vehicles that park in the driveway or below the roof outside of the cellar or in such a manner that it causes an obstruction will be removed.

 

5. Service Hours 

5.1. The reception desk is open from 08:00 to 17:00 Monday to Fridays and 10:00 to 16:00 on weekends and public holidays. The after-hours contact number is 079 886 1775.

5.2. Reservations office hours are: Monday to Friday from 08:00 to 17:00.

5.3. Subject to availability of rooms, persons interested in booking accommodation and wishing to view the property may do so provide a room is vacant and that they do not cause disruption to in-house guests.

 

6. Smoking 

6.1. Buildings belonging to Val du Charron Wines (Pty) Ltd, Guesthouse, Coach House, Piza e Vino @Val du Charron, The Grillroom @Val du Charron  and Spa are NON SMOKING areas. Indoor smoking is strictly prohibited in ALL our rooms and enclosed public areas. Guests found to be smoking in their rooms will be liable to pay an additional night’s accommodation. No exception can be made.

 

7. Security and Storage

7.1 Although Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd takes reasonable steps to ensure the safety and security of guests and their possessions, guests retain final responsibility for their own safety and security. Keep rooms locked at all times and place valuables in the safe provided. Upon Check out please leave the safe open and room locked.

7.2. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd does not provide storage facilities for personal belongings or vehicles.

7.3. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd can not be held liable for any hired equipment / furniture lost or damaged while on our premises.

 

8. Breakfast Service 

8.1. Breakfast is served weekdays and weekends and public holidays between 08:00 – 10:00 in the Grillroom. Should you require an earlier breakfast please advise the reception the night before.

8.2. No refunds are made in the event of breakfast not taken for whatever reason. As a courtesy to please let reception know if you will not be taking breakfast.

 

9. Housekeeping Service 

9.1. All guest rooms are serviced daily between 08:00-15:30.

 

10. Internet Service 

10.1. Wireless access is available in most rooms. This service is offered FREE of charge with the expectation that guests will utilize this service in a professional and responsible manner in accordance with Val du Charron Wines/VDC Eat (Pty) Ltd’s Communication Policy summarised below. By using this service, you hereby accept our conditions of use as follows:

10.2. The FREE Wireless Internet service is for activities such as the active use of e-mail, instant messaging, browsing the World Wide Web and accessing corporate intranets.

10.3. High volume data transfers, especially sustained high volume data transfers, are not permitted.

10.4. Hosting a web server or any other server by use of our service is prohibited.

10.5. Trying to access someone else’s account, sending unsolicited bulk e-mail, collection of other people’s personal data without their knowledge and interference with other network users is prohibited.

10.6. Reselling this service to a third party is prohibited.

10.7. Val du Charron Wines/VDC Eat (Pty) Ltd reserves the right to suspend the service to a guest if we believe that usage of the service is unreasonably excessive or being used for criminal or illegal activities.

10.8. Guests are responsible to maintain the confidentiality of their passwords and all activities that occur under their username and password and will be liable for any losses, damage and costs incurred by Val du Charron Wines/VDC Eat(Pty) Ltd due to the loss, misuse and/or disclosure of guest’s Usernames and passwords.

10.9. Val du Charron Wines/VDC Eat (Pty) Ltd provides this service on an “as is” basis, and will endeavour to provide uninterrupted FREE Wireless Internet access, however we cannot guarantee that the service will be available at all times and in all parts of the guest house. We reserve the right to modify or temporarily suspend the service or any part of it without prior notice.

10.10. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd will not disclose your contact information to any third party without your prior consent, but by Law we are required to assist in the investigation of any suspected or alleged crime or civil wrong, including disclosure of guests contact information.

10.11. By using our wifi you agree to us sending marketing and promotional information to you.

10.12. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd do not provide additional security to our network users as we provide Internet access only and do not interfere with content, and therefore cannot be responsible for security and information transmitted via our service. Guests are responsible to maintain their own security whilst dealing with the Internet or their corporate Intranet.

10.13. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd will not be liable for the accuracy, completeness or relevance of any information obtained through our service from the Internet.

 

11. Privacy Policy

11.1. Commitment to your privacy
11.1.1. Welcome to the Website set out in item 1.6 of the Schedule (“Website”), owned and operated by the Organisation set out in item 1.1 of the Schedule (“Organisation”). The Organisation is committed to protecting the privacy of the user of the Website. The Organisation values the trust of its subscribers and all others who work with it, and the Organisation recognises that maintaining your trust requires transparency and accountability in how the Organisation handles your Personal Information. This privacy policy (“Policy”) is incorporated into and is subject to the Organisation’s standard terms and conditions and the general terms relating to the use of the Website.
11.1.2. In performing the Organisation’s services in the ordinary course of business, the Organisation may collect, use and disclose Personal Information. Anyone from whom the Organisation collects such information can expect that it will be appropriately and lawfully protected and that any use of or other dealing with this information is subject to consent, where this is required by law. This is in line with the general privacy practices of the Organisation.
11.1.3. This Policy sets out how the Organisation collects, uses, discloses, and safeguards the Personal Information it processes in the course of its business.

 

11.2. Definitions
11.2.1. In this Policy, in addition to the other terms that have been defined in the body of the Policy, the Organisation makes use of the following terms:
11.2.1.1. “Personal Information” means all information which may be considered to be personal in nature or information about an identifiable natural and / or existing juristic person (where applicable) in terms of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), the Consumer Protection Act 68 of 2008 (“CPA”) and the Protection of Personal Information Act 4 of 2013 (“POPIA”); and
11.2.1.2. “User, you, your or yourself” refers to any person who makes use of the Website for any purposes whatsoever, whether or not such use is free of charge or paid for.
11.2.2. In addition, unless the contrary is specified, terms that are used in the Policy that are specifically defined in POPIA, are given the meanings ascribed to them in POPIA.

 

11.3. What personal information does the organisation collect and why?
The Organisation may collect Personal Information in conducting its ordinary business operations, including through the use of its Website. In processing such Personal Information, the Organisation at all times ensures that (i) it complies with the provisions of POPIA, and (ii) such Personal Information is used for legitimate business purposes.

 

11.4. Obtaining consent
The Organisation does not, except where otherwise permitted by law, collect, use or disclose your Personal Information without your consent.

 

11.5. Use and disclosure of personal information
12.5.1. The Organisation operates its Website, and conducts its business in general, in accordance with South African legislation. The Organisation considers it imperative to protect the privacy interests of data subjects.
12.5.2. In the event that the Organisation sends Personal Information outside of South Africa (including if such information is hosted offshore), the Organisation will ensure that it takes all reasonable steps to ensure that it complies with all applicable laws in this regard, including POPIA.

 

11.6. Retention of personal information
All Personal Information retained on the Organisation’s database, including such information obtained through the use of the Website, is in accordance with the retention provisions set out in the applicable laws and regulations of South Africa, including those set out in POPIA.

 

11.7. Your rights in relation to your personal information
11.7.1. It is important to note that you have rights in relation to your Personal Information.
11.7.2. You have the right to contact the Organisation at any time to ask the Organisation to:
11.7.2.1. confirm that it holds your Personal Information (at no charge);
11.7.2.2. provide you access to any records containing your Personal Information or a description of the Personal Information that the Organisation hold about you (subject to payment of a prescribed fee); and / or
11.7.2.3. confirm the identity or categories of third parties who have had, or currently have, access to your Personal Information (also subject to payment of a prescribed fee).
11.7.3. The Organisation’s contact information is as set out in item 1.1 of the Schedule.
11.7.4. When you make a request regarding your Personal Information, the Organisation will take reasonable steps to confirm your identity.
11.7.5. There may be times when the Organisation cannot grant access to your Personal Information, including where granting you access would (i) interfere with the privacy of others, or (ii) result in a breach of confidentiality. The Organisation will always provide you with reasons if this is the case.
11.7.6. If you are of the view that any Personal Information that the Organisation holds about you is incorrect in any way, including that it is inaccurate, irrelevant, outdated, incomplete or misleading, you are allowed to ask the Organisation to correct it. If you believe that any Personal Information that the Organisation holds about you is excessive or has been unlawfully obtained, you can ask the Organisation to destroy or delete it. You may do the same if you think that the Organisation has retained if for longer than necessary, given the purpose. The Organisation will do so unless there are good grounds not to (such as that the Organisation is required to hold it for a period prescribed by any applicable legislation).
11.7.7. It is important, however, to understand that if you withdraw your consent for the Organisation to use some of your Personal Information, it may affect the quality and level of service that the Organisation can provide to you.

 

11.8. Security
11.8.1. The Organisation has adopted a security model to protect your Personal Information that complies with generally accepted information security practices and procedures. As part of the Organisation’s security systems, the Organisation has implemented fire-wall technology, password controls, encryption processes and antivirus software. This is in addition to the physical security measures adopted by the Organisation to ensure that it takes all appropriate, reasonable technical and organisational measures to prevent (i) loss of, damage to, or unauthorised destruction of Personal Information, and (ii) unlawful access to or processing of Personal Information. The Organisation has a stringent security policy in place that every officer, employer and supplier of the Organisation must adhere to.
11.8.2. The Organisation confirms that it takes all reasonable measures to:
11.8.2.1. identify all reasonably foreseeable internal and external risks to any Personal Information in its possession or under its control;
11.8.2.2. establish and maintain appropriate safeguards against any risks that are identified by the Organisation;
11.8.2.3. regularly verify that these safeguards are effectively implemented by or on behalf of the Organisation; and
11.8.2.4. ensure that such safeguards are continually updated in response to new risks or deficiencies in previously implemented safeguards.

 

11.9. Cookies
11.9.1. The Website uses cookies in a limited way.
11.9.2. Cookies are small files containing information that a Website uses to track a visit by a user. The Organisation uses session cookies to better understand how the Website is used by users to improve the performance of the Website for users, particularly the way search pages are delivered. The Organisation has installed settings on the Website to ensure that session cookies do not remain on your computer at the end of your visit to the Website, and cannot be used to obtain any personally identifiable details.

 

11.10. Third-party websites

11.10.1. The Website may contain links to third party websites. In the event that you follow a link to any of these websites, it is important to note that these websites have their own terms of use and privacy policies and that the Organisation does not accept any responsibility or liability for them. If you (i) are a client of the Organisation, or (ii) are a user of the Website, and you have purchased products or services from the Organisation, the Organisation may use your contact details to send you details of any new similar products or services which the Organisation thinks you would be interested in. In doing so, the Organisation will at all times comply with any applicable direct marketing laws.
11.10.2. Any communications that you do receive from the Organisation pursuant to clause 11.1 will set out how to opt out of receiving future communications from the Organisation, free of charge, if you no longer wish to receive material for any reason whatsoever. The Organisation will only send you marketing messages when you tick the relevant boxes at certain times when engaging with the Organisation.
11.10.3. As the Organisation is not responsible for any representations, information, warranties and / or content on any Website of any third party (including websites linked to this Website), the Organisation does not exercise control over third parties’ privacy policies and the onus is on the User to refer to the privacy policy of any such third party before providing them with any of your Personal Information.

 

11.11. Updating of privacy policy
The Organisation, in its sole discretion, reserves the right to update, modify or amend this Policy from time to time with or without notice. You therefore agree and undertake to review the Policy whenever you visit the Website. Save as expressly provided to the contrary in this Policy, any amended version of the Policy shall supersede and replace all previous versions thereof.

 

11.12. Contact information
Questions, concerns or complaints related to this Policy or the Organisation’s treatment of Personal Information should be directed to the email address set out in item 1.5 of the Schedule.

 

12. Loss or Damage to Val du Charron Wines/ VDC Eat (Pty) Ltd’s Property

12.1. The guest retains personal liability for any loss or damages caused to the property of VDC Eat (Pty) Ltd and/or Val du Charron Wines (Pty) Ltd (excluding wear and tear).

 

13. Pets

13.1. Family rooms 14 and 15 are pet friendly.
13.2 No pets are allowed in any other rooms or the premises.

 

14. Washing and Towels

14.1. The guest/s of the guest house may not hang their washing or towels over the patio railing.

 

15. Liquor

15.1. Please note that Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd is a licensed property and therefore we have liquor on the premises. We cannot sell to under 18’s. We also do not allow guest/s to consume liquor bought off premise in public areas. We reserve our rights to apply a corkage charge.

 

16. Swimming Pools 

16.1. No children under the age of 16 are allowed in the area of the Guesthouse of pool or individual Coach House pools without an adult’s supervision. Guests make use of the swimming pools at own risk and therefore Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd will not be held liable for any loss, damage, injury or death resulting from guests’ use of these areas. Guests may not eat pool, drink or dive into any pool and if may be asked to vacate the premises immediately if they do not adhere to this. This is to protect all the guests that stay at the Guesthouse and Coach House.

 

17. Dams

17.1. No children under the age of 16 are allowed in these areas without an adult’s supervision. No diving or swimming is allowed in the dams. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd, staff and management will not be held responsible for any loss damage, injury or death resulting from guests’ use of these areas or equipment. Guests make use of these areas at own risk.

 

18. Working Farm 

18.1. Please note that this is a working farm. As a working farm with open water and machinery, entry is at own risk. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd and the management and staff thereof shall not be held responsible for any loss damage or death caused to the guest/s or their property while on the farm or in the cellar area.

18.2. Val du Charron is a food manufacturing facility that must operate to HACCP and Codex Alimentarius standards to ensure that the products it provides wholesome and safe. Tours are generally open groups with interest in wine processing, but are limited in regard to the number available and times. All visitors are required to abide by the following established guidelines to ensure that the food products made and the equipment and facilities are not jeopardized and that the visitors are protected from harm or injury:

a. Wear appropriate clean clothing:

– no overly loose or dragging articles that may be caught in machinery

b. Wear clean, closed toed shoes only

– no sandals or flip-flops; sneakers are acceptable

c. Hair nets and, beard covers where appropriate, will be given out and required to be worn.

d. Limit jewelry to tight fitting rings, watches and bands

– no loose jewelry that can fall off or be caught in machinery

– no large dangling ear-rings; small ear-rings can be tucked in hair nets

e. Generally good hygiene; clean hands, free from strong perfumes/colognes/odors, etc.

f. No food, drinks or chewing gum to brought into the cellar

g. Those with illnesses that may be spread through foods should not enter the plant. Symptoms that should be considered a risk include:

– intestinal illness with repeated severe diarrhea

– strong nausea, vomiting

– high fever, chills, jaundice, hepatitis

h. Do not touch any equipment, buttons, etc. unless instructed to do so. Participants need to be very careful and be aware that floors can be slippery, equipment can be hot, piping and fixtures may be at head level.

 

19. Dogs and Cats

Please beware that there are dogs and cats on the farm. Please be kind to them. Val du Charron Wines (Pty) Ltd and VDC Eat (Pty) Ltd and the management and staff thereof shall not be held responsible for any loss damage or death caused to the guest/s or their property as a result thereof.

 

20. Drones 

Please respect the privacy of the Guests and residents of the property and refrain from flying drones over the houses and Coach House and Guesthouse.

 

21. General Incapacity 

The Val du Charron Wines (Pty) Ltd, the Guesthouse and Coach House and spa cannot be held liable if any of the following events or conditions prevents Val du Charron Wines (Pty) Ltd, the Guesthouse or Coach House and spa from fulfilling its obligation to guests. VDC Eat (Pty) Ltd will take all reasonable steps to minimise disruption and discomfort to Guests under these conditions.

21.1. Unanticipated interruption to the electricity, internet, water, sewage to or from the property.

21.2. Industrial action, civil uprising or criminal activity.

21.3. Fire, frost, flooding, subsidence or any other force majeure event.

 

22. Disclaimer and Right of Admission 

22.1. Val du Charron Wines (Pty) Ltd,  VDC Eat (Pty) Ltd, their staff and management will not be held responsible for any loss damage to property injury or death to person incurred on the property by whatsoever cause. Val du Charron Wines (Pty) Ltd,  VDC Eat (Pty) Ltd, their staff and management will not be held responsible for any death or injury incurred by person sleeping on top bunk.

 

23. Covid cancellation policy will apply in these scenarios: 

23.1. Booking for 2 pax; 1 room: One guest tested positive and as a result and therefor his/her partner do not want/can travel alone, so the booking gets cancelled within 14 days. They did submit the required test result certificate for the 1 person. We will offer a 6 month extension for the booking to remade. If this is not possible, we will refund.

23.2. Booking for 4 pax; 2 rooms: One guest tested positive and as a result the family of 4 have to cancel their trip to SA within 14 days prior to arrival (self-isolation / cannot leave the person home alone). They did submit the required test result certificate for the 1 person. We will offer a 6 month extension for the booking to remade . If this is not possible, we will waive fees but need to confirm it is indeed a family.

23.3. Booking cancellation received within 14 days prior to arrival due to SA lockdown / Home country lockdown travel restrictions. We will offer a 6 month extension for the booking to remade . If this is not possible, we will waive fees subject to provision of proof.

Covid cancellation policy will apply in these scenarios: 

23.1. Booking for 2 pax; 1 room: One guest tested positive and as a result and therefor his/her partner do not want/can travel alone, so the booking gets cancelled within 14 days. They did submit the required test result certificate for the 1 person. We will offer a 6 month extension for the booking to remade. If this is not possible, we will refund.

 

24. Special days and events  including but not limited to Christmas, New Year, Valentines and Black Friday.

24.1. Grande – Grande special does not apply on public holiday Thursdays.

24.2. Black Friday
a. The burger special does not apply to gourmet burgers.
b. Sauces are charged extra.
c. No take away burgers.
d. Wine is bought at the Cellar door sale is bought voets stoots and may not be exchanged or refunded.
e. Wine bought at the Cellar door sale is subject to corkage if consumed on premise.
f. Wine is not for sale to under 18s.
g. Clients are urged to drink responsibly.

24.3. Black Friday, Christmas lunch, New year’s eve, Valentine’s day
a. 50% deposit is required to secure your place on Christmas lunch and New year’s Eve
b. A deposit may be required to secure your table for groups of over 10 on Black Friday
c. A deposit may be required to secure your table for Valentine’s Day

 

25. General

25.1. Val du Charron Wines/ VDC Eat reserves the right to cancel, reschedule or move the event should minimum numbers not be reached or in the event of inclement weather  or force majeure.

25.2. Val du Charron Wines/ VDC Eat reserves the right substitute ingredients when necessary.

25.3. Food is  prepared  in kitchens where nuts, seeds and other allergens including gluten are used.   While every effort will be made, traces of gluten and other allergens may be present in the final served dish.
